Privacy Notice on the Protection of Personal Data Regarding the Use of Aras Burası Locker (Android)

As Aras Kargo Yurt İçi Yurt Dışı Taşımacılık A.Ş. ('Aras Kargo'); amongst our top priorities come the confidentiality and security of your personal data. Accordingly, in order to fulfil our disclosure obligation arising from Article 10 of the Law No. 6698 on the Protection of Personal Data ('KVKK”), we would like to inform you about your personal data processed and transferred if you choose to receive or return your orders from Aras Burası Locker.

1. Which of your personal data are processed by Aras Kargo?

The following includes your personal data subject to processing by Aras Kargo for when you choose to collect or return your orders from Aras Burası Locker:

• Your Identity Information: Your name and surname,
• Your Contact Details: Your telephone number
• Location Information: information on your current location

2. What are the legal grounds for processing your personal data, as well as collecting it?

Your identity and contact information: Where you encounter a problem whilst collecting or returning your orders from Aras Burası Locker, in order to contact you in case you report a problem and to follow up on your requests and complaints; your identity and contact information are automatically collected and processed through the screens in the electronic environment through the mobile application, in line with the legal provisions 'Data processing is necessary for the establishment, exercise or protection of any right' regulated in subparagraph e) of paragraph 2 of Article 5 of KVKK and 'Processing of data is necessary for the legitimate interests pursued by the data controller, provided that this processing shall not violate the fundamental rights and freedoms of the data subject' regulated in subparagraph f) of paragraph 2 of Article 5 of the KVKK (Personal Data Protection Law).

Your location information: For the delivery or return of your orders of Aras Burası Locker, if you use the Android mobile operating system, it is necessary to establish a Bluetooth connection between the Aras Burası Locker and your phone, and in order for the Bluetooth connection to work properly, your location information is automatically collected and processed through the screens in the electronic environment by the mobile application on the basis of the express consent legal ground regulated in paragraph 1 of article 5 of the KVKK (Personal Data Protection Law).

Please be reminded that a Bluetooth connection cannot be established between Aras Burası Locker and your device if you don’t allow access to your location data via your operating system, meaning that the delivery of your order from the Aras Burası Locker will not be possible, but you can always use our other delivery options. You can only give permission to access your location data while using our app. You can change your location preferences at any time from the settings menu on your device.

3. Does Aras Kargo share/disclose your personal data?

Your personal data may be disclosed to our suppliers, with whom we cooperate in accordance with the provisions of Article 8 of the KVKK on the disclosure of personal data only for the above-mentioned purposes, as well as to the competent public bodies, institutions, and organisations, judicial authorities or competent law enforcement authorities in order to comply with legal obligations.

4. Further information regarding customer rights and requests

You can submit your requests within the scope of Article 11 of the KVKK 'regulating the rights of the data subject' within the scope of the 'Communiqué on the Procedures and Principles of Application to the Data Controller', by using the 'KVKK Data Subject Application Form' available at www.araskargo.com.tr/en/privacy-notice/aras-burasi-android-privacy-notice or by sending a written petition to Rüzgarlıbahçe Mahallesi Yavuz Sultan Selim Caddesi Aras Plaza No:2, 34820 Kavacık/Beykoz/İstanbul provided that you confirm your identity, by personally applying to Aras Kargo Yurt İçi Yurt Dışı Taşımacılık A. Ş. ('Aras Kargo') in person, by sending an e-mail to Aras Kargo's registered e-mail address araskargo@hs02.kep.tr by using a registered electronic mail (KEP) address and secure electronic signature or mobile signature, or by sending an e-mail to kisiselveri@araskargo.com.tr (In this application, Aras Kargo reserves the right to request additional identity authentication depending on the nature of the request) by using your e-mail address previously notified to Aras Kargo and registered in Aras Kargo's system.

If you, as the person concerned, submit your requests regarding your rights to Aras Kargo, Aras Kargo will process your request free of charge within 30 (thirty) days at the latest. However, if the response to your request incurs costs in accordance with the legislation, Aras Kargo may charge a fee in accordance with the tariff established by the Personal Data Protection Committee.
