1. Introduction

At Aras Aras Kargo Yurt İçi ve Yurt Dışı Taşımacılık A.Ş. (“Aras Kargo”), we - in our capacity as a Data Controller - place utmost importance in the confidentiality of your personal data since we respect that the information which you share with Aras Kargo are proprietary and confidential.

This present privacy policy is intended to inform the users (the “Users”) of Aras Kargo’s mobile application (“Our Application”) about the personal data which are collected, the methods of collection thereof, and the legal basis therefor, the identity of the third parties to which/whom personal data may be transferred and the purposes for such transfer, their rights concerning the personal data and the manner in which such rights may be exercised.

Our privacy notices which have been drafted pursuant to the Law on the Protection of Personal Data No. 6698 (the “LPPD”) specifically for each service are accessible from the “Legal Information” section in our mobile application. You can access detailed information – specific to each of our services – about the personal data which are collected, the purposes for the processing of such data, the third parties to which/whom such data may be transferred and for which purposes, our method of collection of your personal data and the legal basis therefor.


2. The Categories of Information Collected and Timing and Method of Collection

2.1. Your Personal Data Collected through Contact Forms

We electronically collect the following data by automated means, through the contact forms with which you can communicate your requests and complaints to Aras Kargo:

  • Name-surname;
  • Phone number;
  • Electronic mail address;
  • Province and name of branch;
  • Tracking number;
  • Message.

Detailed information on your personal data which are processed through such form are accessible at any time from “Privacy Notice for Contact Form” available under the heading of “Legal Information” in our Application. Additionally, a link is provided at the bottom of the form concerned, in order to facilitate your access to the privacy notice.


Your Personal Data Collected through Sign-up Form

We electronically collect the following data by automated means, through the sign-up form which you fill in to sign up to our Application:

  • Name-surname;
  • Turkish ID number;
  • Date of birth;
  • Electronic mail address;
  • Phone number.

Detailed information on your personal data which are processed through such form are accessible at any time from “Privacy Notice for Sign-up Form” available under the heading of “Legal Information” in our Application. Additionally, a link is provided at the bottom of the form concerned, in order to facilitate your access to the privacy notice.


2.3. Your Personal Data Collected through “Parcel Tracking and E-Commerce Tracking”

We electronically collect your parcel tracking number details by automated means, through Parcel Tracking and E-Commerce Tracking service, on the basis of the legal ground of the processing of the personal data pertaining to the contracting parties being required, provided that the processing is directly related to the conclusion or performance of the contract, as stipulated in article 5(2)(c) of the LPPD, for the purposes of the offering of the service sought by your party and enabling you to view the parcel movements.


2.4. Your Personal Data Collected through “Request Pick-up” Service

We electronically collect the following data by automated means, through Request Pick-up service:

  • Name-surname;
  • Turkish ID number;
  • Year of birth;
  • Phone number;
  • Electronic mail address; and
  • Postal address

Detailed information on your personal data which are processed through such form are accessible at any time from “Privacy Notice for Request Pick-up Form” available under the heading of “Legal Information” in our Application. Additionally, a link is provided at the bottom of the form concerned, in order to facilitate your access to the privacy notice.


2.5. Your Personal Data Collected through “Closest Branch” Menu

We electronically collect your location data by automated means, through the closest branch menu, which enables you to find out the branch in the closest proximity to your location. If you do not grant permission to our Application to access your location, such service cannot be offered to you. You may always find out our closest branches from our website, call center and live support channels.


2.6. Your Personal Data Collected through “Collect from Aras Burası Lockers” Service

We electronically collect the following data by automated means, through our Aras Burası locker service:

  • Name-surname;
  • Phone number;
  • Location.

Detailed information on your personal data which are processed through such form are accessible at any time from “Privacy Notice for Aras Burası Locker” available under the heading of “Legal Information” in our Application. Additionally, a link is provided at the bottom of the service request concerned, in order to facilitate your access to the privacy notice.


3. Our Purposes for Using your Location Data

When you click the “closest branch” tab in our Application, you should permit the processing of your location data by our Application in order to enable us to display our branches which are in the closest proximity to your location. You may enable such permission, as allowed only while using our Application (“While in Use”). Another service which we provide in our Application and which requires the processing by Aras Kargo of your location data is our “Collect from Aras Burası Locker” service. You may unlock the Aras Burası locker containing your order, by clicking on the “open locker door” over our Application. However, this service may be offered only via a Bluetooth connection between your device and the locker. If you are using an Android operating system, you should allow the processing by our Application of your location data, in order for the Bluetooth connection to work properly. You may grant our Application While in Use permission. You may change the location permissions from the settings menu of your device at any time.


4. Your Data which are Automatically Collected when you Access our Application

Upon the use of our Application, we electronically collect the IP address, Device ID information, connection port, connection time, device operating system and version, device type, hardware model identifier pertaining to your device under the processing/transaction data category, by automated means, on the basis of the legal grounds of (i) the processing of the personal data pertaining to the contracting parties being required, provided that the processing is directly related to the conclusion or performance of the contract, as stipulated in article 5(2)(c) of the LPPD; (ii) data processing being required for the data controller’s compliance with a statutory obligation, as stipulated in article 5(2)(ç) of the LPPD; and (iii) data processing being required for the legitimate interests of the data controller, provided not to impair the fundamental rights and freedoms of the data subject, as stipulated in article 5(2)(f) of the LPPD, for the purposes of (a) fulfillment of our Users’ individual or corporate requests and needs; (b) offering of the services sought thereby; (c) development and inspection of our technical infrastructure; (d) advancement of the hardware and software technologies used by Aras Kargo and other services; and (e) compliance with our statutory obligations.


5. Measures Adopted to Protect your Personal Data

For the purposes of the lawful processing and retention of your personal data which you share with Aras Kargo and the ensuring of the access of solely authorized persons thereto, we adopt any and all reasonable technical and administrative measures within the bounds of the current technological possibilities, including anti-virus software and firewall systems.


6. Third Parties with which/whom your Personal Data are Shared

Your personal data are transferred to the following parties for the following purposes:


  • to our business partners and suppliers, for the facilitation of the services offered on our Application, conducting our activities, ensuring the security and satisfaction of our Users and assuring the quality of the services so rendered, in accordance with the LPPD and other applicable legislation in force; and
  • to authorized persons and public institutions, for the compliance with our statutory obligations, settlement of legal disputes and processing your applications correctly, pursuant to the legal regulations and legislation.
7. Your Rights as a Data Subject

Pursuant to article 11 of the LPPD, as a data subject, you are entitled to:

a) know whether your personal data are processed by Aras Kargo or not;
b) request information thereon if your personal data have been processed;
c) learn the purpose for the processing of your personal data and whether such data were used in conformity with such purpose or not;
d) know about the third parties in Turkey or abroad to whom/which personal data are transferred;
e) request the rectification of your personal data in case of incomplete or inaccurate processing;
f) request the notification of third parties, to which/whom your personal data have been transferred, about the operations carried out according to sub-clauses (e) and (f);
g) object to any outcome reached to your detriment by means of the analysis of the processed data exclusively through automated means;
h) claim compensation in case you suffer damage due to unlawful processing of your personal data.

You may submit your application and requests concerning your personal data to Aras Kargo, by using the data subject’s application form or via a written petition, and by:

  • posting it to Rüzgarlıbahçe Mahallesi Yavuz Sultan Selim Caddesi Aras Plaza No:2, 34820 Kavacık/Beykoz/İstanbul (provided that you verify your identification);
  • personally delivering it to Aras Kargo Yurt İçi Yurt Dışı Taşımacılık A.Ş. (“Aras Kargo ”) (provided that you verify your identification);
  • e-mailing it to Aras Kargo’s registered electronic mail address (araskargo@hs02.kep.tr) from your registered electronic mail (KEP) adress and as signed with your secure electronic signature or mobile signature;
  • sending an e-mail to kisiselveri@araskargo.com.tr from your e-mail address which had previously been notified to Aras Kargo and which is registered in Aras Kargo’s system. (With respect to this application method, Aras Kargo reserves the right to seek additional identity authentication, depending on the subject of request).

As per the Communiqué on the Procedures and Principles for Application to Data Controllers, the following information should be included in the application made by the Data Subject: name-surname, (if the application is in writing) signature, Turkish ID number (passport number if the application is not Turkish), residence workplace address for service, electronic mail address for notification (if available), phone and facsimile number and the details on the subject of request.
